1. Acceptance and Modification of Terms

Welcome to smsapis.com (the "Platform"). Before registering, logging in, or using any service provided by the Platform — including but not limited to purchasing phone numbers, receiving SMS messages, calling APIs, and topping up your account balance — please carefully read and fully understand all terms of this Agreement. By checking "I have read and agree to the User Agreement" or by actually using the Platform, you are deemed to have read, understood, and accepted all terms of this Agreement.

The Platform reserves the right to modify these terms at any time. The modified terms will be published on the website and take effect immediately upon publication. Your continued use of the Platform after the publication of modified terms constitutes your acceptance of the revised terms.

2. Scope of Services

The Platform is an online SMS reception ("SMS receiving / number rental") service that provides virtual phone numbers — covering the United States, Canada, and other countries and regions — mainly for developers and business users. Services include:

• Purchasing usage rights of virtual numbers for specified countries and specified platforms (apps/sites), per-use or by quantity;
• Receiving SMS verification codes from third-party platforms via the web dashboard or HTTP API;
• Filtering and purchasing numbers by remaining validity days (1-10, 11-30, 31-60, 61-90+ days);
• Auxiliary services such as account recharge, balance inquiry, order history, and number release.

The Platform reserves the right to change, suspend, or terminate part or all of its services at any time, without liability to you or any third party.

3. Account Registration and Security

• You agree to provide true, accurate, and complete information during registration, and to keep it up to date.
• You are responsible for safeguarding your credentials — account name, password, API Token and recharge/purchase session. Any account compromise, fund loss, or API misuse caused by your own negligence shall be borne solely by you.
• Each user may register and maintain only ONE account. Multi-account abuse, arbitrage, or fraudulent bulk actions may result in suspension / permanent ban of all associated accounts and forfeiture of remaining balance.
• You may not lend, rent, sell, transfer, or sublicense your account to any third party. Violation will lead to immediate account termination.

4. Recharge, Billing and Refunds

• The Platform operates on a prepaid balance model. Services are billed per number / per use, and prices shown on the purchase page at the time of order apply.
• Recharge amounts are non-withdrawable, non-transferable, and non-refundable for cash. Balance stays valid indefinitely until fully consumed.
• Once a number is purchased and successfully assigned, no refunds or replacements will be accepted regardless of whether a verification code is received — unless the number is proven unusable due to Platform-side failure.
• If a purchased number cannot receive ANY SMS (including non-target platform messages) continuously within 30 minutes of purchase, you may contact support for verification. Refund or replacement is at the Platform's sole discretion.
• Accounts banned for violation of this Agreement are not eligible for balance refunds.

5. Number Usage Rules

• What you purchase is only usage rights of the number during its remaining validity period. Full ownership belongs to the carrier and the Platform; numbers are automatically recycled upon expiry.
• You may extend validity via the renewal feature (if available). Numbers not renewed before expiry will be permanently disabled and cannot be recovered.
• Each number may only be used on the specific platform and specific business scenario selected at purchase to receive a verification code. Cross-platform re-use or secondary resale is prohibited.
• The Platform is not liable for failed code reception caused by factors outside our reasonable control, including but not limited to: third-party platform (Google, Meta, Baidu, Tencent, etc.) risk-control changes, number blacklisting by the target service, or carrier network failures.
• If you are found re-using the same number across multiple platforms, or reselling / forwarding verification codes to others, the Platform reserves the right to immediately reclaim the number, deduct the corresponding balance, and permanently ban the account.

6. API Usage and Fair Use Policy

• When calling the HTTP API, you must comply with the rate limits documented in the official API documentation. Malicious polling, DDoS, or abuse of endpoints is strictly forbidden.
• API Tokens are sensitive credentials. You are fully liable for any losses resulting from leaked Tokens. You can reset your Token in the dashboard at any time.
• The Platform may temporarily or permanently ban offending IP addresses / Tokens / accounts that exceed reasonable rate limits, without refund.

7. User Conduct

You agree NOT to engage in any of the following acts while using the Platform:

• Violating laws of the People's Republic of China or of your own jurisdiction — including fraud, money laundering, gambling, pornography, drug-related offences, cyberattacks, or sending spam messages;
• Registering third-party accounts with Platform numbers for illegal / abusive purposes such as bulk farming, fake account creation, inflated metrics, malicious registrations, or selling registered accounts;
• Harassing, defaming, threatening, extorting, defrauding any third party, or otherwise infringing on others' legal rights;
• Using crawlers, scripts, bots, or automated tools to purchase in bulk, hog numbers without real usage, or otherwise manipulate inventory;
• Cracking, decompiling, reverse-engineering the Platform software, or attempting to bypass any security or billing mechanism;
• Any other conduct that may harm the Platform or the legitimate rights of any third party.

Violation of any provision above may result in immediate account suspension / permanent ban, balance forfeiture, number reclamation, and pursuit of legal remedies by the Platform.

8. Privacy and SMS Content

You understand and agree that all SMS content received by numbers under your account will be retained by the Platform for a reasonable period to allow you to view and download. Except as required by law or lawful requests from judicial or governmental authorities, the Platform will not disclose such SMS content to any third party. You may not use this service to receive content containing others' personal privacy, trade secrets, or illegal material. See also the Privacy Policy.

9. Disclaimers

• The Platform and its services are provided on an "AS IS" and "AS AVAILABLE" basis, without any warranties, express or implied, regarding availability, timeliness, stability, accuracy, or reliability.
• The Platform is not liable for service interruption, number invalidation, or SMS delay / loss caused by carrier issues, target-platform risk control, cyberattacks, power failures, or force majeure (earthquake, fire, flood, war, pandemic, government action, etc.).
• Any and all legal consequences arising from your registration or actions on third-party platforms are borne solely by you and are independent of the Platform.
• In no event shall the Platform's aggregate liability under this Agreement exceed the total service fees you actually paid to the Platform during the 30 days immediately preceding the date of the claim.

10. Termination

You may terminate this Agreement at any time by closing your account. If you materially breach this Agreement, the Platform may unilaterally terminate it and ban your account immediately; remaining balance will not be refunded. Termination does not affect accrued rights and obligations of either party prior to the termination date.

11. Governing Law and Jurisdiction

This Agreement is governed by and construed in accordance with the laws of the People's Republic of China. Any dispute arising from this Agreement shall be resolved through amicable negotiation; if negotiation fails, either party may submit the dispute to the competent People's Court at the location of the Platform's operating entity.
